Winamax Poker Terms and Conditions

Article 1: Third-party help


1.1 Inter-player collusion

It is prohibited for two (2) or more Players to collaborate during any Game. Any form of collusion is forbidden, more notably it is forbidden for two (2) or more Players to communicate or share information in any way about a Game, the cards each Player has during a Game or to adopt a strategy (before or during a Game) in order to mutually gain an advantage and/or harm other Players. This includes the use of the Website chat, Winachat, third-party instant messaging systems and prohibited software (as defined below). “Chip-dumping”, which involves a player voluntarily losing to profit another player is also forbidden.

In cases of suspected fraud, Winamax reserves the right to consult the conversations between players via the Website chat or Winachat. These conversations may be consulted by the Security Department and if necessary, be used in order to demonstrate fraudulent activity and/or collusion from the players in question.

 

1.2 Prohibited software

Any player wishing to use assistance software that is not available in the list of authorised software below must first get permission from our Game Integrity Team (integrity@winamax.com) who will only study issues relating to assistance software.

The assistance software authorized on the Winamax gaming platform include:

  • software informing the player about odds and starting hands
  • software for storing personal game statistics, player game history, notes and analysis of opponent statistics data that the player themself has collected during the game ("profiling"), e.g. HoldemManager, PokerTracker, Xeester, ...
  • software that pre-programs certain keys on the keyboard but does not affect the playing technique in any way. Example: WinHotKey.

 

Certain software provides an unfair advantage and is strictly prohibited on the Site. These are incompatible with honest and fair play. Most of these software constitute blatant cheating and Winamax will use all means at its disposal to detect them.

The prohibited software include (non-exhaustive list subject to validation by our Game Integrity Team):

  • robots ("poker bots" and "auto-folders") automated to advise, take actions or make decisions on behalf of the player. The player must always be the physical person who has registered on our platform www.winamax.fr. Example: Warbot, WinHoldem, ...
  • “solver" type software that allows you to view and browse game trees created according to several predefined parameters. Example: InstaGTO, PioSolver, GTOpoker, ...
  • ICM calculators, i.e. the software that allows you to calculate the payout according to the proportion of chips each player has at any given moment in the tournament. Example: ICMIZER, Coffecalcs, SimpleNash, ...
  • “dynamic" range software, i.e. changing according to the progress of the hands, as well as calculators that make it possible to obtain the percentage of chance of winning a given hand according to different parameters (“equity"). Example: Equilab, SnapShove, ...
  • software that make it easier to open tables, such as "seating scripts", which allow you to sit down automatically. Example: NEED4SEAT, Hiroku, ...
  • the use of virtual machines (VMs) and remote control software. Example: VMware Tools.

As part of the fight against all forms of fraudulent behaviour on its tables, Winamax reserves the right to analyse all software processes running on the player's computer terminal only when the Winamax software is open.

If fraud is detected (use of prohibited software, for example), Winamax will take all necessary measures to preserve the integrity of the game. These measures include possible sanctions against the incriminated player, and may go as far as the definitive closure of the Winamax account and the confiscation of the player's funds.

In case of suspicion of fraud, Winamax reserves the right to request additional information from the player concerned. If the answers provided by the latter prove unsatisfactory and are not sufficient to resolve the problem(s) encountered, Winamax will take all necessary measures to protect and secure its gaming tables. Sanctions may also be applied, which may include the closure of the Winamax account and the confiscation of funds if necessary.

Any attempt to circumvent or evade these analyses may result in the closure of the player's Winamax account and the confiscation of funds.

 

Article 2: Tournament and cash game rules


The general rules of Poker are described on the Website, and we encourage players to review these before participating in any games.

The Website clearly displays specific rules of each cash game and tournament, including: the particular variation of poker, the number of players, minimum and maximum wagers, specific registration requirements, commissions, and the possible prize amounts.

You must review and accept any specific rules before you may access a game (tournaments and cash games).

The Website offers two distinctive services:

  • Cash games and tournaments on international tables set up in accordance with the Shared Liquidity Agreement reserved for players with a fully validated account in the various European countries included in the Agreement.
  • Standard cash games and tournaments reserved for players signed up to Winamax.fr (temporary accounts and accounts with documents validated). These tables are marked with a French flag on the Site.

While playing on the Site, you may win or be given entry tickets granting you access to certain tournaments. Such tickets have a limited date of validity. Once this date surpassed, the ticket will expire and will no longer be available for use.

Unforeseen circumstances may cause Winamax to change the rules of a tournament (levels speed, blinds levels, starting stack, length of a day for tournaments which last more than one day, prize structure, etc.) in the interests of the game without warning. These decisions are taken in an impartial fashion and may, in certain circumstances, prevail over the conditions detailed in article 3.

Winamax reserves the right to cancel or postpone tournaments without warning.

A player’s private cards from tournament finals or in Expresso jackpots of at least x1,000 can be exposed post-game by Winamax (in the context of commentated videos, articles etc.)

Tournament winnings are distributed as indicated in the tournament lobby except when a deal is made (https://www.winamax.fr/en/deal-making) or when the tournament is cancelled (see article 4). The prize structure may change until the end of late registration.

In rebuy tournaments, players must have the necessary funds available in their account in order to rebuy. Any funds in play in other games are not considered as available.

The duration of late registration is indicated in the tournament lobby (https://www.winamax.fr/en/late-registration). The duration indicated is the maximum duration of late registration. In all tournaments (excluding “qualification” tournaments), this period may be shortened if the number of players remaining is too close to the number of paid places. In this case, late registration ends. For all tournaments, the prizes cannot be paid out while late registration is open.

In the case of “knockout” tournaments, the guarantee corresponds to the size of the prizepool and the total amount in bounties. If the guarantee is not reached, the amount missing is added to the prizepool, the bounty on each player remains unchanged.
In the case of “qualification” tournaments, the number of paid places may potentially be higher than the number of players remaining during late registration without interrupting the game. A player may be alone at a table waiting for other players. No prize can be awarded while late registration is open.

It is not possible to unregister during late registration.
 

 

Article 3: Malfunction, disconnection, and bugs


It may happen that you will be subject to a malfunction, disconnection or bug while playing a cash game or tournament. The Site is aware of the inconvenience caused by such incidents and will do its best to resolve any problem and, if necessary, compensate players in the event that the incident was caused by the Company’s servers.

Should you be victim of a disconnection, you may contact our customer support via e-mail. Your request will be reviewed with the greatest possible attention. All disconnections are analysed in detail by our customer support and, if proven, the player is reimbursed and/or compensated within 3 working days.

 

3.1. Incidents related to the player’s computer or internet connection

In such cases, the Website cannot be held responsible for any inconvenience or damage incurred.

If you are playing a tournament, you will be automatically put into "absent” mode and will therefore only lose your blinds until you are able to reconnect. If you already wagered money or chips at the moment of the disconnection, your wager will unfortunately be lost should the hand be lost.

If you are playing a cash game, you will be automatically put in to "absent” mode. Your money will be temporarily frozen on the table, to be automatically returned to your account after several minutes. If you already wagered money or chips at the moment of the disconnection, your wager will unfortunately be lost should the hand be lost.

 

3.2 Disconnections caused by Website servers

If you have been injured, the Company agrees to reimburse you within a delay of 3 working days, under the conditions described below.

 

3.2.1. Tournaments

When a tournament is stopped definitively, you are likely to be compensated if you were still participating in the game at the time of the incident. One of several cases may occur:

(i) The tournament for which you have registered has not yet started: you will be reimbursed in full. Should you have registered using a ticket, the ticket will be re-credited.

(ii) A server side incident occurs after AT LEAST ONE player has been eliminated from the tournament:

a) If paid winners have not yet been determined and late registration to the tournament is still available, one half of the actual prize pool (which could be less than the guaranteed prizepool) is shared out equally between the remaining players and one half of the prize pool is shared out prorata in function of each player’s remaining chips at the time the incident began (the time the incident began will be impartially determined by Winamax). . The commission (rake) is also refunded to the remaining players: all players still in the tournament are therefore guaranteed to receive at least the original buy-in (commission included).

b) If paid winners have not yet been determined and late registration to the tournament is closed, one half of the prize pool is shared out equally between the remaining players and one half of the prize pool is shared out prorata in function of each player’s remaining chips at the time the incident began (the time the incident began will be impartially determined by Winamax). The commission (rake) is also refunded to the remaining players: all players still in the tournament are therefore guaranteed to receive at least the original buy-in (commission included).

c) Should paid winners have already been determined:

  • all remaining players will be reimbursed the tournament commission (rake);
  • each remaining player will receive an amount corresponding to the next paid place;
  • one half of the remaining prize pool will be shared out equally between the remaining players at the time the incident began (the time the incident began will be impartially determined by Winamax),,
  • the other half of the remaining prize pool will be shared out according to the number of chips held by each remaining player at the time the incident began (the time the incident began will be impartially determined by Winamax).

d) In “progressive knockout” tournaments, the remaining bounties in play will be added to the prizepool when calculating reimbursements.

e) Should a “Day 1” of a “Flight” tournament be cancelled or interrupted, the real prizepool of the “Day 1” in question will be taken into account for the reimbursement calculation in cases a), b), and c).

f) In the case of the "Hit & Run" tournaments, having a winning entry is not taken into account in the different refunds. A refund will be applied where (a) the tournament is always open for late entries and where b) the tournament is no longer open for late entries.

g) In the case of “Expresso” tournaments, the randomised prizepool will be taken into account when calculating reimbursements.

In the case of Expresso tournaments where the winner takes the whole prizepool, one half of the prize pool is shared out equally between the remaining players and one half of the prize pool is shared out prorata in function of each player’s remaining chips at the time the incident began (the time the incident began will be impartially determined by Winamax). The commission (rake) is also refunded to the remaining players. Players are not guaranteed to take more than their initial buy-in.

In the case of Expresso tournaments where the prizepool is shared between the 3 players:

  • all remaining players will be reimbursed the tournament commission (rake);
  • each remaining player will receive an amount corresponding to the next paid place;
  • one half of the remaining prize pool will be shared out equally between the remaining players at the time the incident began (the time the incident began will be impartially determined by Winamax),
  • the other half of the remaining prize pool will be shared out according to the number of chips held by each remaining player at the time the incident began (the time the incident began will be impartially determined by Winamax).

3.2.2  Cash games

Your money will be temporarily frozen on the table, to be automatically returned to your account after several minutes.

 

Article 4: In-game behaviour


It is forbidden to divulge information concerning your hand or your future actions when facing multiple adversaries.

It is forbidden to sit down at a cash game table without the intention of playing in order to block the seat and prevent others from playing. If you join a cash game table, you must play or abandon the seat.

The same applies if you are waiting alone at a cash game table; if an opponent joins your table, you must either play or leave. However, it is forbidden to follow a player from table to table who does not wish to play against you.

In cash game games starting heads-up, the practice of “buttoning”, that is, playing only your button, is forbidden. You must necessarily play the next hand if you are on the button on the first hand, before sitting out.

It is forbidden to voluntarily disconnect yourself from the internet in order to benefit from additional decision making time.

All forms of “softplay” are forbidden either with the aim of helping prevent a friend from being eliminated but also with the intent to earn a higher rank in a challenge (https://www.winamax.fr/en/challenges) or Guns and Glory (https://www.winamax.fr/en/guns-and-glory-gangs).

 

Article 5: Software licensing and disclaimer


The use of the Site allows players to access certain software, code and information developed by the Company (“Software”) and made available through the Website, by download or otherwise. The Company grants players who have downloaded the Software a non-exclusive, non-transferable, revocable and limited license to access and use the Software.

The Software is the property of the Company. It is therefore forbidden to alter it in any manner or to use it for any means other than to access the Website.

The Company is not responsible for the content of third-party sites that are accessible via links on this Website.
